Terms of Service

These Terms of Service ("Terms") govern your use of the DictateHub app for iPhone and iPad ("the App"), provided by Motu Dev LLC ("we," "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in accordance with these Terms and the Apple Media Services / App Store Terms of Service.

2. Subscriptions, billing, and the free trial

DictateHub offers optional auto-renewing subscriptions ("DictateHub Pro") that unlock additional features.

  • Plans currently offered: a monthly plan and an annual plan; the annual plan may include a 7-day free trial for new subscribers. Current prices and any trial terms are shown in the App at the point of purchase and may vary by region.
  • Payment is charged to your Apple Account at confirmation of purchase.
  • Auto-renewal: Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
  • Free trial: If you start a free trial and do not cancel at least 24 hours before it ends, it converts to a paid subscription at the then-current price. Any unused portion of a free trial is forfeited if you purchase a subscription.
  • Manage or cancel anytime in your Apple Account settings (Settings → your name → Subscriptions). Deleting the App does not cancel a subscription.
  • Refunds are handled by Apple under the App Store Terms; we do not separately process refunds.

3. Your content and your connections

The App records audio and lets you attach metadata, store it on your device, connect to systems you configure (databases, storage destinations), and export your recordings. You are solely responsible for:

  • the content you record and the metadata you attach;
  • obtaining any consents required to record audio under the laws that apply to you;
  • the systems, credentials, databases, and storage destinations you connect the App to, and your compliance with their terms and applicable law; and
  • ensuring your use complies with any professional, privacy, or data-protection obligations that apply to your work (for example, in healthcare or legal contexts).

We do not receive, store, or process your recordings or their metadata on our servers. See the Privacy Policy.

4. Acceptable use

You agree not to misuse the App, including: using it unlawfully; recording people without required consent; infringing others' rights; attempting to reverse engineer, decompile, or circumvent the App except as permitted by law; or using it to harm, overload, or gain unauthorized access to any system.

5. Third-party services

The App can connect to third-party services you choose (e.g. your databases, S3-compatible storage, iCloud, other apps). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services.

6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that recordings, lookups, or exports will always succeed. You are responsible for verifying that critical recordings and exports complete successfully and for maintaining your own backups.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, RECORDINGS, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Changes to the App and these Terms

We may modify or discontinue features, and may update these Terms. Material changes will be reflected here with a new "Last updated" date. Continued use after changes take effect constitutes acceptance.

9. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Maintenance, support, and warranty/claims handling are as described in the App Store Terms and these Terms.

10. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.
